These Terms & Conditions ("Terms") govern your use of the WhenYou mobile application, website, and related services (collectively, the "Service"). The Service is owned and operated by AutoShine, LLC, doing business as WhenYou ("WhenYou," "we," "our," or "us").

By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 18 years old to create an account or use WhenYou.

By using the Service, you represent that:

  • You are at least 18 years old.

  • The information you provide is accurate and current.

  • You have the legal authority to enter into these Terms.

2. Your Account

You are responsible for:

  • Maintaining the confidentiality of your login credentials.

  • All activity occurring under your account.

  • Keeping your account information accurate and up to date.

We reserve the right to suspend or terminate accounts that violate these Terms or are used fraudulently or unlawfully.

3. Subscription Services

WhenYou is offered through a recurring subscription.

An active subscription provides access to premium features including:

  • Creating and sending scheduled love notes

  • Receiving scheduled love notes

  • Your private Love Story archive

  • Additional premium features released in future updates

Subscription pricing is displayed within the App Store or Google Play before purchase.

Subscriptions automatically renew unless canceled before the renewal date through your Apple App Store or Google Play account settings.

4. Billing, Renewal & Cancellation

Subscriptions renew automatically unless canceled before the renewal period begins.

You may cancel your subscription at any time through your App Store or Google Play subscription settings.

Cancellation prevents future charges but does not provide refunds for the unused portion of an active billing period unless required by applicable law or the applicable app marketplace.

Billing and payment processing are handled by Apple or Google—not by WhenYou.

5. Refund Policy

Because subscriptions are purchased through Apple App Store or Google Play, refunds are governed by the policies of those platforms.

WhenYou does not process or issue refunds directly.

6. Your Love Notes and Content

WhenYou exists to help couples privately share appreciation, encouragement, and meaningful moments.

You are responsible for the love notes and other content you create through the Service.

You retain ownership of the content you create.

By using the Service, you grant WhenYou permission to securely store, transmit, and display your content solely for the purpose of providing the Service to you and your partner.

We do not sell your personal love notes or use them for advertising.

Access to saved love notes and subscription features requires an active subscription.

If your subscription expires, is canceled, or is not renewed, access to subscription features—including your saved love notes—may be suspended or unavailable.

We do not guarantee that content will remain stored or available indefinitely after a subscription ends.

7. Privacy

Your privacy is important to us.

8. Account Deletion

You may request deletion of your account at any time.

Deleting your account permanently removes your account information in accordance with our Privacy Policy.

9. Acceptable Use

You agree not to:

  • Use the Service for unlawful purposes.

  • Attempt to gain unauthorized access to the Service.

  • Interfere with or disrupt the Service.

  • Upload malicious software or harmful code.

  • Harass, abuse, threaten, or impersonate others.

  • Violate any applicable laws while using the Service.

We reserve the right to suspend or terminate accounts violating these Terms.

10. Intellectual Property

The Service—including its software, design, graphics, logos, trademarks, content, and branding—is owned by AutoShine, LLC, DBA WhenYou and is protected under applicable intellectual property laws.

Except for the content you create, no part of the Service may be copied, modified, distributed, or reproduced without prior written permission.

11. Third-Party Services

The Service may contain links to third-party websites or services.

We do not control or endorse those services and are not responsible for their content, privacy practices, or availability.

12. Service Availability

While we strive to provide reliable service, we do not guarantee uninterrupted availability.

The Service may occasionally experience maintenance, outages, software updates, or technical issues.

13. Disclaimer

The Service is provided "as is" and "as available."

To the fullest extent permitted by law, WhenYou disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

14. Limitation of Liability

To the maximum extent permitted by law, AutoShine, LLC, DBA WhenYou and its owners, officers, employees, affiliates, and contractors shall not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages arising from your use of the Service.

Our total liability for any claim relating to the Service shall not exceed the amount you paid to WhenYou during the twelve (12) months preceding the claim.

Some jurisdictions do not allow certain limitations of liability, so portions of this section may not apply to you.

15. Indemnification

You agree to indemnify and hold harmless AutoShine, LLC, DBA WhenYou, its owners, employees, affiliates, contractors, and agents from any claims, damages, liabilities, losses, or expenses arising from:

  • Your use of the Service;

  • Your violation of these Terms; or

  • Your violation of applicable law or the rights of another person.

16. Changes to These Terms

We may update these Terms periodically.

When material changes are made, we will update the Effective Date and may notify users through the Service or by email when appropriate.

Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

17. Governing Law

These Terms are governed by the laws of the State of Utah, without regard to conflict of law principles.

Any legal dispute relating to these Terms shall be resolved in the state or federal courts located in Utah unless applicable law provides otherwise.
